State v. O.S
In May 2019, Emily Gladden and Noell Tin succeeded in getting a second-degree murder conviction overturned, securing their client’s freedom a few years into his 15-19 year sentence. O.S. was convicted of second-degree murder for the death of his lifelong best friend after they hit a tree while driving drunk and were thrown from the vehicle. There was strong evidence not presented at trial suggesting that O.S. was not the driver and therefore innocent. Ms. Gladden and Mr. Tin worked for years to investigate and develop the ineffective assistance of counsel claim which they presented in a lengthy Motion for Appropriate Relief. The prosecutor was moved by these arguments and consented to relief.
